Terms of Service

These terms govern your use of Aviato — the Aviato server software, the official Aviato mobile and web apps, the aviato.media and ato.software websites, and the Aviato Afterburner subscription service. References to “Aviato” in these terms cover all of the above. By installing, accessing, or using Aviato, you agree to these terms.

Who we are

Aviato is built and operated by Ato LLC, a New Hampshire limited liability company.

Your license to use Aviato

Aviato is proprietary software owned by Ato LLC. Subject to your ongoing compliance with these terms, Ato grants you a personal, non-exclusive, non-transferable, revocable license to install and run Aviato on hardware you own or control. Aviato is licensed, not sold; Ato retains all rights not expressly granted by these terms.

Aviato is licensed for personal, non-commercial use. Personal use includes use by you and the household, friends, and family with whom you choose to share access. Commercial use — including reselling Aviato access as a service, embedding Aviato in a paid product, or operating Aviato as the media-delivery layer of a business — is not permitted.

You may not:

  • Distribute, resell, sublicense, or publish Aviato or any of its components.
  • Circumvent, disable, or interfere with license validation, paid feature gates, or any other security or rights-management mechanism in Aviato.
  • Reverse engineer, decompile, or disassemble the Aviato server software or any other proprietary Ato component. Aviato exposes a plugin system, webhooks, and public APIs as the supported integration surface; reverse engineering of the server is permitted only to the minimum extent that applicable law expressly forbids the prohibition.
  • Use Aviato in violation of these terms, the Copyright Policy, or applicable law.

Acceptable use

You agree not to use Aviato to:

  • Harass, threaten, or harm others.
  • Infringe the intellectual property or other rights of any third party, including patents and copyrighted works.
  • Violate any applicable law.
  • Damage or harm the goodwill or reputation of Ato or its services.
  • Impersonate any person or entity.
  • Distribute viruses or other harmful files or software.
  • Distribute junk, spam, or unauthorized advertising.

Plugins, integrations, and APIs

Aviato is extensible through a plugin system, webhooks, and public APIs. The Aviato plugin marketplace distributes software written by third-party developers. Ato curates the marketplace but does not warrant or audit individual plugins. You install plugins at your own risk and subject to each plugin’s own terms.

Aviato may also integrate with third-party services. Those services are governed by their own terms and privacy notices, which apply to your use of the integration.

Support

Aviato is designed for self-hosting and self-management. Use of Aviato does not entitle you to support, installation assistance, or service-level commitments. Ato may make community resources available from time to time, but support is not a contractual obligation under these terms.

Aviato Afterburner subscription

Aviato Afterburner is the paid tier of Aviato, available as a monthly or annual subscription. Pricing and the billing cadence you select are shown at point of sale. Your subscription renews automatically at the end of each billing period until you cancel. Each Afterburner license is tied to a single server; licenses may not be shared, transferred, redistributed, or activated on additional servers.

Cancellation. You may cancel future renewals at any time from your Ato account or by emailing help@ato.software. Cancellation prevents the next renewal; your license remains active through the end of the period for which you have already paid.

No refunds. Subscription fees are non-refundable, including for partial billing periods, unused time, or after cancellation. This provision does not waive any non-waivable refund right granted to you by applicable law.

Suspension and termination by Ato. Ato may suspend or terminate your Afterburner subscription if you breach these terms, or if a payment is declined, reversed, or charged back. Where reasonable, Ato will give you notice and an opportunity to cure before suspending or terminating.

Security

Aviato is a self-hosted media server that you may choose to expose to the public Internet. You are solely responsible for the security of the systems on which you run Aviato, including network configuration, transport security, authentication, and access control. Ato does not warrant that Aviato is free from defects or security vulnerabilities.

Disclaimer of warranties

Aviato is provided AS IS and AS AVAILABLE, without warranty of any kind. To the fullest extent permitted by law, Ato disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. Ato does not warrant that Aviato will be uninterrupted, error-free, or fit for your specific requirements. Ato may modify, suspend, or discontinue Aviato, or any feature of Aviato, at any time.

Limitation of liability

To the fullest extent permitted by law, Ato will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, revenue, profits, or business interruption, arising out of or relating to Aviato or these terms, even if Ato has been advised of the possibility of such damages.

Ato’s total cumulative liability for any claim arising out of or relating to Aviato or these terms will not exceed the greater of (a) the amounts you paid Ato for Afterburner in the twelve months preceding the event giving rise to the claim or (b) US$50.

These limitations form an essential basis of the bargain between you and Ato and apply even if a stated remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, Ato’s liability is limited to the minimum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Ato LLC and its members, employees, and contractors from and against any third-party claim, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of (a) your use of Aviato, (b) your breach of these terms, or (c) your infringement of any third party’s rights.

Export controls and sanctions

You may not use, export, or re-export Aviato in violation of U.S. export controls or economic sanctions, and you may not access Aviato from any country subject to a comprehensive U.S. embargo. By using Aviato, you represent that you are not located in such a country, are not on any U.S. government list of restricted parties, and will not provide access to any person who is.

Termination

You may stop using Aviato at any time by uninstalling it. Ato may suspend or terminate your access to Aviato — including any Afterburner subscription — if you materially breach these terms. The provisions of these terms that, by their nature, are intended to survive termination — including the license restrictions, ownership, indemnification, disclaimer of warranties, limitation of liability, and governing law — will survive.

Governing law and venue

These terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or Aviato will be brought exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and each party submits to the personal jurisdiction of those courts.

Severability

If any provision of these terms is held unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be made enforceable, severed; the remaining provisions will continue in full force and effect.

Changes to these terms

Ato may update these terms from time to time. The “Last updated” date above will reflect any change. Material changes will, where reasonable, be communicated to Afterburner subscribers by email. Continued use of Aviato after a change becomes effective constitutes acceptance of the updated terms.
